Once an initial evaluation is carried out, cases are transferred to a licensed Insolvency Practitioner who calculates repayments on the applicant’s current income. The licensed Insolvency Practitioner will then draft a proposal and negotiate directly with creditors. If creditors agree to the IVA, they are agreeing to freeze interest and charges and write off any debts (included in the IVA) that still exist at the end of the arrangement which typically lasts 5 years.
An IVA is subject to creditor agreement, which isn’t always guaranteed.
If you are a homeowner, you may be required to release equity in the fourth year of the IVA to repay creditors. However this depends on your personal situation.
